William Woody of the County of Lincoln and State of Tennessee, being weak in body but of a perfect and sound mind and memory thanks be to God for the same, do make and ordain this my Last Will and Testament in the manner and form as followeth:
First, I give my soul to God who gave it to me, and my body to the earth to be decently buried and bequeath unto my beloved wife Jane Woody the whole of the tract of land whereon I now live, houses, household furniture and appertenances thereunto belonging during her widowhood. I likewise give and bequeath unto my wife all my stock of horses, cattle, sheep and hogs during her widowhood. My will and desire is in case my wife marry again I give devise and bequeath the said tract of land that is given to her during her widowhood to my son William Banks Woody, his heirs and assigns forever.
I give, devise and bequeath unto my wife in case she marry again, the third part of all my stocks of horses, cattle, sheep and hogs that may be left at the time of such marriage to her her heirs and assigns forever. The balance of the said household furniture I give devise and bequeath unto my daughter, Jane Woody excepting one bed and furniture I give and bequeath unto my son William B. Woody their heirs and assigns forever. The balance of the said stocks of horses, cattle, sheep and hogs and all other personal estate I give, devise and bequeath unto my son William B Woody and to my daughter Jane Woody to be equally divided between them at the time of the marriage of my wife if such a event should happen.
In case my wife should not marry all the land that is willed to her during her widowhood, at her death, I give, devise and bequeath the said land to my son William Banks Woody his heirs and assigns forever also all the personal estate of every kind that may be left at the death of my wife. I give, devise and bequeath unto my son William Banks Woody and to my daughter Jane Woody to be divided between them in the same manner as provided in this will in case my wife marry again. My desire is in case either my son William B. Woody or my daughter Jane Woody departs that life without having lawful heirs of their body then the estate given to them by this will shall go to the survivor or the one that out lives the others all the rest of my children Sarah Hilton, Biddy Huff, Betsy Buchanan, John Woody and Nancy Fulington, I have given them their parts of my Estate some time ago as much as I intend to give them.
I do hereby appoint my wife Jane Woody Executrix and my son John Woody and son in law James Buchanan, Executors to this my last Will and Testament.
